REGULATIONS ON STATE PRICE APPRAISAL SERVICE FEES

For general customers

Prices of price appraisal services are specified in Article 11 of Decree No. 89/2013 / ND-CP detailing the implementation of a number of articles of the Law on Prices of valuation as follows:

1. The price appraisal service price is implemented under the agreement between the price appraisal enterprise and the price appraisal customer according to the provisions of Clauses 2, 3 and 4 of this Article stated in the price appraisal contract. In case of bidding for price appraisal services, the provisions of bidding law applicable to consultancy service bidding packages shall be complied with.

2. Bases for determining price appraisal service prices:

a). Content, volume, nature of work and time to perform price appraisal.

b). Actual reasonable business costs corresponding to the quality of services include:

- Salary costs

- Expenses incurred during the process of surveying, collecting, analyzing and processing information

-  Financial expenses

-  Selling expenses

-  Enterprise Cost Management

- Other expenses as prescribed by law

c). Cost of purchasing professional liability insurance or expenses for setting up occupational risk reserve fund.

d). The expected profit (if any) ensures that the price appraisal service price is consistent with the similar price appraisal service market price.

e). Financial obligations as prescribed by law.

3. Based on the provisions of Clause 2 of this Article, the price-appraising enterprise shall issue and post up the price appraisal service price list of its enterprise according to the provisions of Clause 6, Article 4 and Clause 5, Article 12 of the Law. prices in the form of package service prices, in percentage (%) of the value of assets or project value subject to price appraisal and other forms decided by enterprises in accordance with the provisions of law. the law.

In addition, the content of expenses for buying professional liability insurance or expenses for setting up occupational risk reserve fund at Point c, Clause 2 of this Article are also guided by Clause 2, Clause 3, Article 6 of Circular 38/2014. / TT-BTC.

Regarding the equitization of State enterprises

The cost of valuation of enterprise valuation for equitization of State enterprises is determined by the Ministry of Finances Circular No. 196/2011 / TT-BTC of December 26, 2011. This cost is estimated to be 30-40% of the equitization cost as follows:

- Not exceeding VND 200 million for enterprises with a value of under VND 30 billion.

- Not exceeding VND 300 million for enterprises with a value of from VND 30 billion to VND 50 billion.

- Not more than VND 400 million for enterprises with a value of over VND 50 billion - VND 100 billion.

- Not exceeding VND 500 million, for enterprises valued at over VND 100 billion.

In case the enterprise applies the underwriting method, resulting in the equitization cost exceeding the prescribed framework, the Equitization Steering Committee shall report to the equitization-deciding agency for consideration and approval in the stock plan. partialization.

Thus, the price appraisal service price is implemented according to the agreement between the price appraisal enterprise and the customer. The cost of valuation of enterprise valuation for equitization of State enterprises is determined according to the Circular No. 196/2011 / TT-BTC of December 26, 2011 of the Ministry of Finance.
